The Overseas Territories Airworthiness Requirements (OTARs) describe the means by which aircraft operators, aviation personnel and service providers can gain approvals, licences and certificates.

In some instances, they also form Instructions given under powers under the Air Navigation (Overseas Territories) Order.

The OTARs ensures adequate levels of safety and internationally agreed standards are met.

Regarding Part 43

Part 43 concerns the following elements

(1) the maintenance of aircraft which are required to have a certificate of airworthiness issued under OTAR Part 21 Subpart E; and

(2) the release to service after the maintenance of aircraft which are required to have a certificate of airworthiness issued under OTAR Part 21 Subpart E; and

(3) the maintenance and arrangements for the release for a flight of aircraft operating under a Permit to Fly

Note Concerning PART Part 21 Subpart E

Subpart E β€” Certificates of Airworthiness

Details Requirements Governing the Airworthiness Certification of Aircraft.

(a) Certificates of Airworthiness issued under this Subpart are based on the airworthiness standards of the applicable Type Acceptance Certificate.

(b) A Certificate of Airworthiness issued under this Subpart may contain operating conditions and limitations.

(c) An Aircraft Flight Manual approved by the State of Type Certification is associated with and forms part of the Certificate of Airworthiness.

Regarding Part 145 Option 1 & Option 2

To recognise that an Option 1 approval is achieved on the back of an existing EASA / FAA / Transport Canada Approval (Typically the normal route for achieving approval)

An Option 2 Approval, on the other hand, is relevant for organisations which hold other than Option 1 approvals or No such approval

Subpart D – Option 2 Requirements

General Note – the process of supporting an EASA requirement with both Acceptable Means of Compliance (AMC) and Guidance Material (GM) is not employed in OTAR Requirements. However to note the use of Overseas Territories Aviation Circulars (OTACs) are issued to provide advice, guidance and information on standards, practices and procedures to support the Overseas Territories Aviation Requirements (OTARs).

145.101 Applicability

Applicability of Subpart β€œD” is an Option 2 Requirement

145.103 Facilities Requirements (Similar to EASA Part 145.A.25)

145.105 Personnel Requirements – Covers the β€œhigh level” requirements AM & QM etc but many differences from EASA Part 145.A.30 where the following details are additional:

  • Maintenance Man Hour Plan
  • Control of Competence
  • Use of “A” Certifying Staff for Task Certification
  • Relationship between C Certifying Staff & Support Staff
  • Process for use of Non-EASA licensed persons in third countries
  • EASA AMC’s covering in detail expectations regarding personnel requirements
  • GM provided for contents of Human Factors Training & Competence

145.107 Certifying Staff – OTAR licence is issued based on existing ICAO Annex 1 licence – new types must be added to the original licence before being added to the OTAR licence

145.109 Equipment Tools and Material – Equivalent to EASA Part 145.A.40 & (42) (EASA far more detailed particularly related to components)
