Commission Regulation (EU) No 1321/2014 of 26 November 2014 is an official consolidated version of Commission Regulation (EC) No 2042/2003 and its amendments published up to date, as follows:

Transfer of Responsibility Joint Airworthiness Authority (JAA) to European Aviation Safety Agency (EASA)

When EASA assumed responsibility for the European Regulatory environment from the JAA the following four areas of Continuing Airworthiness Management, Aircraft Maintenance, Aircraft Maintenance Engineers Training and Aircraft Maintenance Engineers certification privileges where grouped together within a composite regulatory document entitled – Commission Regulation (EC) No 2042/2003.

The document was issued and effective from 20 October 2003, Together with associated Acceptable Means of Compliance (AMC) & Guidance Material (GM).

After several years the process became complicated with the issue of several amendments (Under European Rules each document remains valid rather than superseding its predecessor so the process may become somewhat involved regarding the need to maintain continuous oversight.

To improve matters (to a degree) EASA consolidated and re-issued the regulations in the form of a consolidated release.

1321/2014 includes the following additional comments

“Type training courses approved before the approval of the minimum syllabus of certifying staff type rating training in the operational suitability data for the relevant type in accordance with Regulation (EU) No 748/2012 shall include the relevant elements defined in the mandatory part of that operational suitability data not later than 18 December 2017 or within two years after the operational suitability data was approved, whichever is the latest.”

What is the difference between Commission Regulation (EU) No 1321/2014 of 26 November 2014 and Commission Regulation (EC) No 2042/2003 as amended?
Answer

Some subsequent changes in that new Regulation compared to the old one(s) were deemed necessary but remain very minor, without any impact in its implementation. The following items can be mentioned:

The Cover Regulation, i.e. the recitals and articles at the beginning of the document have been adjusted;

Article 6(3) of Regulation (EU) 1321/2014 introduces new provisions related to the minimum syllabus of certifying staff type rating training in the operational suitability data for the relevant type in accordance with Regulation (EU) No 748/2012, which further refers to Part-66 Appendix III points 1 (a)(ii) and (b)(ii).

Some editorial corrections were introduced with no effect in its implementation.

The existing approved AMCs/GMs covered by the EASA Decisions, which complemented (EC) 2042/2003 as amended , remain valid for newly published Commission Regulation (EU) 1321/2014.

About “Operational Suitability Data” (OSD)

The European Commission has published on 27 January 2014 a new requirement in certification OSD mandating that aircraft manufacturers, including those building helicopters, to submit data EASA considers important for safe operations. OSD covers pilot training, maintenance staff and simulator qualification; the master minimum equipment list (MMEL); and possibly other areas, depending on the aircraft’s systems.

The process begins when the aircraft manufacturer proposes what data EASA will evaluate against the new rule for approval. OSD is approved as part of the type certificate like the airplane flight manual. Since the holder of the type certificate is the owner of OSD, the manufacturer has to keep the data current.
