Sofema Aviation Services (SAS) www.sassofia.com considers the use of the Terms Contract and Sub-Contract and in each case where the responsibility sits for both Quality & Safety activities.

Understanding Contractual and Sub Contractual relationships in an EASA Aviation context.

EASA has adopted a Specific Terminology to identify specific responsibility for certain activities namely:

  • Contracted Activities
  • Sub-contracted Activities

It is important to understand the difference between Contractual and Sub Contractual Relationships in an EASA Aviation context, particularly in respect of a Part M organisation that may have both relationships at the same time with an EASA Part 145 organisation.

Potential Relationships between an EASA Part 145 & Part M Organisation:

  • Maintenance being carried out in accordance with Part 145 Requirements and Certified by the Part 145 Organisation
  • CAMO Support activities being carried out by the Pat 145 Organisation and “owned” by the CAMO Organisation
  • Contract Relationship
  • A contract relationship makes the contracted organisation (The organisation awarded the contract) responsible for the compliances associated with the contracting activity,
  • For example where an operator awards a contract to an EASA Part 145 approved maintenance provider, the responsibility for the certification of the activity also sits with Part 145 (The Contracted Organisation).
  • It should be noted of course that this is not always allowed, for example, it is not possible for an operator to transfer its responsibility for mandatory oversight of its obligation to deliver and ensure compliance with regulatory requirements.

Sub-Contract Relationship – In a Subcontract relationship, the responsibility remains with the organisation issuing the contract.

  • For example, an Operator awarding a contract for ground service support during turn arounds (cannot be contracted) therefore responsibility remains with the Operator.

Considering Quality and Safety Issues

  • Quality & Safety remains the direct responsibility of the Awarding Organization within a Subcontract Relationship.
  • Within a Contract Quality & Safety is the responsibility of the contracted organization & oversight is the responsibility of the awarding organization.
