Introduction
The Basic Role of European Basic Regulation (EU) 2018/1139 (Replacement for Reg 216/2008 which itself replaced 1592/2002) is to enable community management of aviation by the European Commission (EC) overseeing the work of the European Aviation Safety Agency (EASA). The EC is responsible for the issue of Implementing Rules (IR) based on the submission of EASA “Opinions” and EASA itself is responsible for the issue of Acceptable Means of Compliance (AMC) and Guidance Material (GM) based on the development of “Decisions” following the Comment Response Document (CRD) process.
Here we will consider the role of the BASIC Regulation as announced by United Arab Emirates (UAE) Gulf Civil Aviation Authority GCAA.
CAR Basic Regulation
Basic Regulation (CAR-BR) is developed by the General Civil Aviation Authority (GCAA) of the UAE pursuant to the provisions of the UAE Civil Aviation Law and fulfilling the obligations of the Chicago Convention and related Annexes.
CAR-BR stands as common high-level requirements, those essential for the safe conduct of flight operations. It is applicable to all Operators who are issued with an Air Operators Certificate (AOC), Private Operators Certificate (POC), or Authorisation to conduct Flight Operations in the UAE and Approved Training Organizations where applicable.
The BR contains high-level requirements and establishes the essential requirements on specific subject matters through dedicated annexures.
Review of Redacted CAR-BR Requirements
All applicable operators and organisations shall comply unless otherwise approved by the GCAA.
Competent Authority – General Civil Aviation Authority as established by the United Arab Emirates Federal Government.
ARTICLE 1 – SUBJECT MATTER AND OBJECTIVES
The principal objective of this regulation is to establish and maintain a high uniform level of civil aviation safety in the UAE.
The objectives will be achieved in accordance with the provisions in the federal act no. 20 (1991) promulgating the civil aviation law and the federal law no. 04 of 1996.
ARTICLE 2 – SCOPE
The regulation applies to:
The operation of aircraft, as well as their engines, propellers, parts, non-installed equipment, and equipment to control aircraft remotely, where the aircraft is or will be:
· Registered in the UAE, unless transferred to a foreign country (aircraft is operated by a foreign country aircraft operator) – Chicago Convention
· Foreign registered – operated by UAE operator
· Aircraft Operating into or within the UAE
· Applies to relevant persons
Note – Excluded Aircraft
This Regulation shall not apply to:
(a) aircraft, and their engines, propellers, parts, non-installed equipment, and equipment to control aircraft remotely, while carrying out military, customs, police, search and rescue, firefighting, border control, coastguard, or similar activities or services under the control and responsibility of UAE, undertaken in the public interest by or on behalf of a body vested with the powers of a public authority, and the personnel and organisations involved in the activities and services performed by those aircraft.
