Introduction ā€“ One of the challenges which are faced by persons wishing to navigate the EASA regulatory environment in Relation to Part 21 & Certification Specification is the fact that on be known to the ā€œstudentā€ other things are happening in the background.

It is not immediately obvious which is why it is important to raise awareness regarding the following areas:

  • Special Conditions
  • Certification Memoranda
  • Good Practices

What are EASA Special Conditions

  • As of 13 August 22, EASA lists 167 ā€œSpecial Conditionsā€ covering a myriad of topics including Electric / Hybrid Propulsion System, Medical Evacuation to Trust in Machine Learning Systems.

Introductory Note Concerning Special Conditions:

  • The following Special Condition has been classified as important and as such shall be subject to public consultation in accordance with EASA Management Board decision 12/2007 dated 11 September 2007, Article 3 (2.) which states:

o “2. Deviations from the applicable airworthiness codes, environmental protection certification specifications, and/or acceptable means of compliance with Part 21, as well as important special conditions and equivalent safety findings, shall be submitted to the panel of experts and be subject to a public consultation of at least 3 weeks, except if they have been previously agreed and published in the Official Publication of the Agency.
o The final decision shall be published in the Official Publication of the Agency.”

What are EASA Part 21 Good Practices

  • EASA Good Practices intend to clarify specific items of implementing rules for design organisation approvals. They highlight a particular subject and, as nonā€binding material, provide additional technical explanations to current standards. EASA Good Practices are published for information purposes only and must not be regarded as formally adopted Acceptable Means of Compliance (AMC) or Guidance Material (GM).
  • EASA Good Practices do not introduce new or modified rules and do not constitute any legal obligation or right for the Agency or the organisations. EASA Good Practices will be withdrawn if the corresponding rulemaking task listed on the inventory of EASA results in new published regulations, AMC or GM.

What Are EASA Certification Memoranda

EASA Certification Memoranda clarify the European Union Aviation Safety Agencyā€™s general course of action on specific certification items.

  • They are intended to provide guidance on a particular subject and, as nonbinding material, may provide complementary information and guidance for compliance demonstration with current standards.
  • Certification Memoranda are provided for information purposes only and must not be misconstrued as formally adopted Acceptable Means of Compliance (AMC) or as Guidance Material (GM).
  • Certification Memoranda are not intended to introduce new certification requirements or to modify existing certification requirements and do not constitute any legal obligation.
  • EASA Certification Memoranda are living documents into which either additional criteria or additional issues can be incorporated as soon as a need is identified by EASA.
