Sofema Aviation Services (SAS) www.sassofia.com provides an update concerning the introduction of a Safety Management System within an EASA Part 145 Organisation

EASA has issued Commission Implementing Regulation (EU) 2021/1963 which becomes effective on December 2nd, 2021.

Summary of Requirements

  • A management system should be introduced for all maintenance organisations falling within the scope of Annex II to Regulation (EU) No 1321/2014 (‘Part-145maintenance organisations’) in order to comply with the International Civil Aviation Organisation (‘ICAO’) International Standards and Recommended Practices established in Annex 19 to the Chicago Convention.
  • All Part-145 maintenance organisations are required to establish an occurrence reporting system. Therefore, the provisions of Annex II to Regulation (EU) No 1321/2014 should be amended to ensure that the occurrence reporting system is established as part of the organisations’ management system and that the requirements are aligned with those of Regulation (EU) No 376/2014 of the European Parliament and of the Council.
  • To account for Part-145 maintenance organisations that are also approved as Part-CAMO organisations, it is appropriate to harmonise the general provisions as well as the requirements for competent authorities set out in Annex II (Part-145) of Regulation (EU) No 1321/2014 with those set out in Annex Vc (Part-CAMO) to that Regulation.

Regulatory Background

Reference NPA 2019-05 & EASA (RMT).0251 Phase II in EPAS 2019-2023, NPA proposes amendments to Annex I (Part 21) to Regulation (EU) No 748/2012 and Annex II (Part-145) to Regulation (EU) No 1321/2014, in order to:

  • Introduce safety management principles that implement ICAO Annex 19, and foster an organizational culture for effective safety management and effective occurrence reporting in accordance with Commission Regulation (EU) No 376/2014.
  • Phase I of RMT.0251 focused on the introduction of safety management requirements into Part-CAMO (see Opinion No 06/2016).

NPA 2019-05 concerns the embodiment of the safety management system (SMS) requirements into Part-145 and Part 21.

With the adoption of this NPA, Safety Management Systems (SMS) will become applicable in Part-145 approved maintenance organisations, as well as to production and design organisations that are approved in accordance with Subparts G and J of Part 21.

By doing so, safety will be enhanced through:

  • The establishment of safety policies and objectives that are associated with sufficient resources
  • The systematic identification of hazards, and a risk management system
  • The safety assurance system, including giving consideration to safety performance
  • Safety promotion

NPA 2019-05 is divided into three parts

NPA 2019-05 (A) includes:

  • The procedural information pertaining to the regulatory proposal
  • The explanatory note to the proposed amendments
  • The regulatory impact assessment
  • A detailed summary of the proposed amendments (see Chapter 7 ‘Appendices’)

NPA 2019-05 (B) proposes:

The draft implementing rules (IRs) as well as the draft Acceptable Means of Compliance (AMC) and Guidance Material (GM) for Part 21.

NPA 2019-05 (C) proposes:

The draft implementing rules (IRs) as well as the draft Acceptable Means of Compliance (AMC) and Guidance Material (GM) for Part-145.

The core part of the management system framework (145.A.200) focuses on what is essential for safety management, by mandating the organization to:

(a) clearly define responsibilities and accountabilities,

(b) establish a safety policy and the related safety objectives,

(c) implement safety reporting procedures in line with just culture principles,

(d) ensure the identification of aviation safety hazards entailed by its activities, ensure their evaluation, and the management of the associated risks, including:

(1) taking actions to mitigate the risks,

(2) verifying the effectiveness of the actions taken to mitigate the risks,

(e) monitor compliance, while considering any additional requirements that are applicable to the organisation,

(f) keep their personnel trained, competent, and informed about significant safety issues,

(g) document all the key management system processes.
